firefighters fought it for 35 minutes or so. what they learned is the first cows 47 that house was vacant and under construction. the second house was occupied by two people inside. those two occupants were able to get out with no injuries. investigation turning to the cause, they're looking at the vacant house obviously investigators need to get in and take a look at it. to make sure what caused the fire. the one house is completely destroyed, the second one has major damage. the good news is no fire fighters, in no occupants of the houses were injured. >> it is out of the way in hell. so it's not affecting any traffic. >> it is the type street. at the very top of a hill and san rafael so traffic is not the

afternoon. gregory elarms, 58, has been charged with first- degree murder in the killing of activist david lewis, who was gunned down near his car in the parking lot of the hillsdale shopping center on june 9. elarms was arrested on dec. 20, two days after he contacted san mateo police with a tip in the case. elarms is scheduled to reappear in court for a preliminary hearing on feb. 18 at 1:30 p.m. >> and it man whose daughter died in oakland last week will now have this deportation postponed. he was arrested in july while trying to cross the border from mexico into the united states. he will be allowed to attend funeral services for his family, three year-old daughter died thursday morning along with the girl's mother, and a family friend. immigration authorities are making arrangements to escort him to attend the private service for the family members. deportation is postponed

the oakland raiders informed coach tom cable on tuesday that they will not bring him back as coach next season even though he led them to their best record in eight years this season. the raiders announced their decision two days after wrapping up an 8-8 season that gave oakland its first non-losing record since winning the 2002. the raiders left for tampa bay. the raiders also could have interest in stanford coach jim harbaugh, who was a quarterbacks coach in close with davis. harbaugh is also being sought by the san teams. >> trend has been promoted to general motor of the forty- niners. so now the niners are calling to make this a serious run for stanford coach. >> will find out if mark mcgwire can make baseball hall

morning. >> could morning mark. san rafael fire officials are still on the scene. probably will be for a couple more hours. they got the call at one minute after 3:00 a.m., 47 may ward way. they discovered there were two houses on fire, and then this one to three alarms. 40 firefighters fought it for 30 minutes when they got it under control. the fire actually started at 47 may what way. it was a house under construction. the next door house was occupied by two residences side. those residents were able to get out, they did not have injuries. the fire department's turning in investigation to the on occupied home. they say they don't know what caused the fire. they will look at that house as the

sought a car parked in the intersection. they started firing, they were even close. let me show you damage. it took out this piece of metal, down here as well. then they continue firing. hitting suspects in our nursery victims in because they fired him in the shots there're going to be stray bullets. those three homes were caught in the crossfire. some of those homes were hit and one person inside the pink home was hit with a stray bullet. that person is in hospital. you can see the glass from the car. they have recovered the caller according to an investigator this morning. for the people who live here, i talked to a young boy inside the house he says it was so loud, he told his family to get down.
